These Terms of Service (“Terms”) govern your use of the Ghost Financial app and website (collectively, the “Service”) operated by Ghost Financial Inc. (“Ghost Financial”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using Ghost Financial, you confirm that you are at least 18 years of age, have the legal capacity to enter into this agreement, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the Service.

2. Description of Service

Ghost Financial is a personal finance application that aggregates your bank account information for display and analysis. Our Service allows you to:

• Connect Canadian bank accounts in read-only mode via Plaid.
• View balances, transactions, and spending summaries across accounts.
• Receive AI-generated financial insights powered by Ghost AI.
• Track budgets, subscriptions, and other financial goals.

Ghost Financial is not a financial institution, financial advisor, or investment advisor. The information and insights provided through the Service are for informational purposes only and do not constitute financial, investment, legal, or tax advice. We never move, transfer, or hold your money. All bank connections are strictly read-only.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate information when creating your account.
• Keep your login credentials secure and not share them with others.
• Notify us immediately at support@ghostfinancial.app if you suspect unauthorized access to your account.
• Use only one account per person unless expressly authorized.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use automated tools to scrape, crawl, or extract data from the Service.
• Transmit malware, viruses, or any other harmful code.
• Impersonate any person or entity.

We reserve the right to suspend or terminate accounts that violate these guidelines.

5. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the Ghost Financial name, logo, software, design, and text — are owned by Ghost Financial Inc. and are protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.

You retain ownership of any data you provide to the Service. By connecting your bank accounts, you grant Ghost Financial a limited license to access and display that data solely for the purpose of providing the Service to you.

6. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

Financial information displayed through Ghost Financial is for reference only. We are not liable for any financial decisions you make based on information provided by the Service, including AI-generated insights. Always consult a qualified financial advisor before making significant financial decisions.

We rely on Plaid to retrieve your financial data. We are not responsible for inaccuracies, delays, or errors in data provided by third-party services.

7. Limitation of Liability

To the fullest extent permitted by Canadian law, Ghost Financial Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to financial loss resulting from reliance on information in the app.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Subscription Terms

Ghost Financial offers a free tier and a paid subscription called Ghost Pro. The following terms apply to paid subscriptions:

• Billing: Ghost Pro is billed on a monthly or annual basis, as selected at the time of purchase. Pricing is displayed in Canadian dollars (CAD) unless otherwise indicated.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• Cancellation: You may cancel your subscription at any time through your device’s app store subscription settings. Cancellation takes effect at the end of the current billing period — you will retain access to Ghost Pro features until then.
• Refunds: Refunds are governed by the Apple App Store or Google Play Store policies, as applicable. We do not issue refunds directly except as required by Canadian consumer law.
• Price changes: We will provide reasonable advance notice before increasing subscription prices.

9. Termination

You may delete your account at any time through the app settings. We may suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent or abusive behaviour, or for any other reason we deem necessary to protect the integrity of the Service or other users.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including limitations of liability, disclaimers, and governing law) will continue to apply.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Canada and the province of Ontario, without regard to conflict of law provisions. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date and, for material changes, provide notice in-app or by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
